Man Sues XSport Fitness After Exercise Ball Deflates

A man filed a lawsuit against a North Side fitness club Thursday after the exercise ball he was using allegedly deflated, causing him to fall and injure himself.

On June 24, 2009, Michael Ernst was working out at the XSport Fitness facility located at 3240 N. Ashland Ave., according to a suit filed in Cook County Circuit court Thursday.

Ernst was using an exercise ball at the facility when it “collapsed, deflated and became unstable” causing him to fall, the suit said.

The suit claims Capital Fitness, Inc., which owns XSport, was negligent by failing to maintain their exercise balls and providing “defective” balls to customers.

Ernst allegedly suffered injuries of a “personal, permanent and pecuniary nature” from the fall.

The suit asks for more than $50,000 in damages.
